Terms and Conditions
This Agreement governs the sale or rental of equipment by Arcelor Containers to the Purchaser.
Equipment Condition and Grading
Purchaser acknowledges that “Used” containers are retired from international shipping lines.
WWT (Wind and Water Tight): These units will have dings, dents, surface rust, and varied paint colors. They are guaranteed only to be weather-protected.
Cargo Worthy (CW): These units meet the structural standards for international sea transport but may still have significant aesthetic wear.
New/One-Trip: These are the highest grade available but may still have minor scratches from their initial voyage from the manufacturer.
Limitation of Liability
In no event shall Arcelor Containers be liable for any special, incidental, indirect, or consequential damages (including, but not limited to, loss of profits, loss of data, or business interruption) arising out of the use or inability to use the equipment, even if advised of the possibility of such damages. Our total liability shall not exceed the purchase price of the equipment in question.
Indemnification
The Purchaser agrees to indemnify and hold harmless Arcelor Containers from any claims, damages, or expenses (including legal fees) arising from the Purchaser’s use, modification, or transport of the equipment after delivery, including any violations of local zoning laws or building codes.
Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the state/province where Arcelor Containers is headquartered. Any disputes arising from this agreement that cannot be resolved through good-faith negotiation shall be settled through binding arbitration.
